PA School District and Employees Sued

A family in Hampden Township (PA) has sued the Cumberland Valley School District, its director of special education, a principal, and three teachers in federal court. Dr. Andrew and Karen Bloschichak’s son (identified as A.B.), who is 14 years old and has Asperger’s Syndrome, is now attending a private high schoolschool. The Blochichaks claim that their son’s special education plan was not properly handled, that teachers were “abusive,” and that other students bullied their son. As reported in today’s The Sentinel:

As early as first grade, the boy would come home with his hair full of spit from classmates on the bus, the suit states. Students humiliated him more as the years went on — tossing balls at his head, telling him to pull down his pants, urinate in public, use the ladies’ bathroom and pick his nose and eat it.

Bullies allegedly threatened to steal things out of his bedroom, kill his hamsters and shoot the boy with a BB gun.

District staffers knew about the bullying but didn’t stop it, the suit alleges.

In seventh and eighth grade, between 15 and 20 students allegedly rolled dimes down the hall so they could watch the teen catch them. They even put the coins in urinals and toilets for him to retrieve, the suit alleges.

The alleged discrimination against A.B. began in 1998 when he was a first-grader at Shaull Elementary School and continued until his parents withdrew him from the school in August of this year. A.B.’s “disorder is more severe now because of the environment he endured for eight years,” according to the Blochichaks’ suit.
